Terms of Service

1. Acceptance of Terms
By accessing or using ServiceHub ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and ServiceHub, Inc.
2. Description of Service
ServiceHub is an online marketplace that connects clients seeking home and commercial services with independent contractors who provide such services. ServiceHub does not employ contractors and is not responsible for the quality, safety, or legality of services provided.
We act solely as an intermediary, providing the technology platform, payment processing, and trust-and-safety tools that facilitate transactions between clients and contractors.
3. Account Registration
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and accept all risks of unauthorized access
- Promptly notify us of any unauthorized use of your account
- Not create accounts using false identities or for fraudulent purposes
- Be at least 18 years of age to create an account
4. Client Responsibilities
As a client using ServiceHub, you agree to:
- Post accurate job descriptions and respond promptly to contractor inquiries
- Pay for completed work through the Platform's payment system
- Not solicit contractors to work outside the platform to avoid fees
- Treat contractors with respect and professionalism
- Provide a safe working environment for contractors
- Leave honest, accurate reviews after job completion
5. Contractor Responsibilities
As a contractor using ServiceHub, you agree to:
- Maintain all required licenses, permits, and insurance for your trade
- Accurately represent your skills, experience, and qualifications
- Complete contracted work to the agreed specification and timeline
- Not solicit clients to work outside the platform to avoid fees
- Comply with all applicable laws, including labor and tax laws
- Maintain a professional standard of conduct at all times
- Acknowledge that you are an independent contractor, not a ServiceHub employee
6. Platform Fees
ServiceHub charges fees for facilitating transactions on the Platform:
- Clients: No fees for posting jobs or using the Platform
- Contractors (Standard): 15% platform fee on first 10 completed jobs per month, then 10%
- Contractors (Pro, $49/month): 8% platform fee on all completed jobs
Fees are deducted automatically from payments before funds are released to contractors. We reserve the right to modify fee structures with 30 days' notice.
7. Payments and Escrow
All payments are processed through Stripe. When a client accepts a bid:
- Payment is held in escrow until the job is marked complete by both parties
- Funds are released to the contractor within 3-5 business days of job completion
- Disputed payments may be held pending resolution by our team
- Refunds are available for uncompleted or unsatisfactory work per our Dispute Policy
8. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent content
- Harass, threaten, or discriminate against other users
- Attempt to circumvent the Platform's payment system
- Use automated tools to scrape or access the Platform
- Attempt to access accounts or data that do not belong to you
- Post spam, advertising, or unsolicited commercial messages
- Violate any applicable laws or regulations
9. Intellectual Property
The ServiceHub platform, including its software, design, trademarks, and content, is owned by ServiceHub, Inc. and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. Content you post on the Platform remains yours, but you grant ServiceHub a non-exclusive license to use it to operate and improve the Platform.
10. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEHUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
ServiceHub is not liable for the quality, safety, or legality of services provided by contractors; the accuracy of job listings; or any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with AAA rules, except for claims eligible for small claims court.
12. Changes to Terms
We may update these Terms at any time. We will notify you of significant changes via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
